The Attorney General State, Eduardo Torres-Dulce, has decided to file a lawsuit against the president of the Generalitat, Artur Mas, by arranging alternative 9-N query. We finally make a solo after the chief prosecutor of Catalonia, José María Romero de Tejada, does not consider it appropriate, as it announced late Monday afternoon. After several rounds of deliberation, the Board of Procurators of Catalonia has concluded that there is no legal basis to sue Mas.

In this internal inconsistency, Torres-Dulce has convened a Board of Prosecutors room next Wednesday, November 19 in compliance with the requirements of Article 27 of the Organic Statute of the prosecution.

The lack of a solid legal basis for holding the crime was intended to accuse Mas and his vice president, Joana Ortega -desobediencia, but prevarication and even usurpation of functions-is the key factor that made the Catalan fiscal opt for not filing the complaint. Add to this the fact that many organizations are short (mostly political parties) have already filed complaints against the Catalan president and some of his advisers by 9-N. All of them are being trained in various courts and the High Court of Justice of Catalonia has begun to accumulate today. The alternative consultation, therefore, and will be pursued criminally, hence the complaint of the prosecution not be necessary.

In meetings last week, most of the prosecutors who make up the Senior Prosecutor Catalonia (six of nine) were reluctant to file the complaint. Prosecutors not only disagreed with the terms of text sent from Madrid, but on whether to present it. Even examining a single crime (disobedience), believe that the requirements are not met. Although the Constitutional Court suspended any act of preparing 9-N, Mas received no express command to end the alternate query. The same criterion is holding several professors of law and procedure consulted by this newspaper.

On Wednesday afternoon, before the discussion, they met in Madrid Torres-Dulce and senior attorney Catalonia, José María Romero de Tejada. There it was agreed that the complaint be issued in Catalonia, which would be overseen by the Attorney General.
