The European Commission has allowed Spain to return only part of the so-called health cent. According to confirmed sources of the Tax Agency EFE, this tax, declared illegal by the Court of Justice of the EU (TEU), put the amount to be returned by 2,000 million euros, will be much lower than that collected 13,000 million euros.
Spain only return part because full recovery of sums unduly would breach the EU directive that sets the minimum rate of Tax on Retail Sales of certain hydrocarbons (HRST), known as ‘health cent’.
Only the amount to those who claim and submit invoices after justifying payment checks will be returned . the Tax Agency
