The oil operators have been skeptical about the measure announced Friday by the Government as part of the new Highway Act in establishing that the roads can not have three consecutive stations of the same operator to Europa Press sources of the sector.
The sources are cautious given the need to know the detail of the measure announced by the Minister of Development, Ana Pastor, since it is crucial to know whether affect future concessions, as seems more likely, or existing contracts.
In the event that is relevant to the facility existing application would have a significant effect on a network in which Repsol, Cepsa and BP have a much higher implantation of other companies, and on which the Government has already set a limit of 30% in the number of gas stations by province and 30% of the volume sold by province once the Hydrocarbons Law is approved.
In many toll roads, the sections where service stations are installed are assigned often competitive, so that the measure necessary to revise these concessions, which could have legal implications.
There are also questions about what would happen if a gas station to close three of competition quedasen chained, or whether champions entrepreneurs who use the brand of one of the main operators would also be affected by the measure.
Other unknowns to be resolved are the hypothetical requirement that an operator sells or closes a particular gas station without leave ability to manage its portfolio of facilities, or the case of a motorist who has crossed two service stations of an operator and, upon joining a different route, find a third station of the same operator
