Five Days / The Court of Justice of the EU has ruled today that the Rajoy Government had violated the community rules to cease prematurely to the dome of the regulator of the sector telephone (CMT). The verdict calls into question the future of the CNMC , a macroorganismo that could have its days numbered with the future Government.
The CNMC (National Commission of Markets and Competition) was created in 2013 by the merger of the former sectoral regulators (energy, telcomunicaciones, rail, mail, ports and audio-visual) with the former national competition authority. The Government took advantage of the operation to the removal of the dome of the ancient organisms. But the then president of the CMT , Bernardo Lorenzo Almendros, and one of their consejeeros, Xabier Ormaetxea, challenged the decision and have just logged in Luxembourg the first court victory.
The Court of Justice european, in response to a query of the Supreme Court on the case, and has determined that the merger of the regulators, it is compatible with the community rules. But the pre-term termination of the directors of the CMT is in violation of the regulations that require guarantees on the independence of the national regulator of telecommunications.
The statement adds another shadow on the future of the CNMC, an organism that could be cleaved during the present legislature . The agreement between the Popular Party and the Citizens that preceded the failed investiture of Mariano Rajoy in August already provided for the separation of the organsimo, to return to the model of a competition authority and one or several sector regulators.
