The Spanish Justice yesterday sentenced the dome of the airline Spanair jointly and severally pay a fine of 10.8 million euros by the bankruptcy of the company, which ceased operations in January 2012

The Commercial Court number 10 Barcelona blamed the 10-member board of directors, including its former president Ferran Soriano, to delay the bankruptcy five months and thus aggravate the insolvency of the Spanish airline. The judgment also disables them for two years to manage or represent any person or company.

The sentence, dated September 16, also blames the Avançsa public company, which was represented by the Government of Catalonia, which injected millions of euros of public funds to promote the company and the El Prat airport.

The fine is much lower than claimed by the prosecution of Barcelona, requesting 47 million euros.

The sentence imposed on 12 individuals and companies: Ferran Soriano, Michael Balint Szucs, International Fira de Barcelona, Miquel Martí Escursell, Rafael Jordi Bago, Josep Maria Benet i Comercial Holdings Turístiques 2009, Josep Mateu, Catalana d’Initiatives, Benny Zakrisson, Avançsa and Karl Erik Mats Lönnqvist.

The decision of the commercial court of Barcelona specifies that the dire economic situation of the company was known months before submission of the tender and during this time continued to sell tickets normally.

The cessation of operations on land left over 22,000 passengers only the first weekend, and another 60,000 had to be relocated in the coming days.

Spanair was founded in 1986 as a charter airline. In 1994 it began operating regular domestic routes, operations three years later extended to intercontinental.

In 2009, Catalan authorities and business in the region acquired 80% of its capital. The Swedish airline SAS have passed and 19.9%.

One of the ships of Spanair 2008 starred in one of the most tragic episodes in the history of Spanish aviation. An MD-82 bound for Las Palmas de Gran Canaria crashed nothing takeoff from Madrid. 154 people died.

APPEAL. The board advanced yesterday to appeal the guilty verdict on the grounds that “acted with due diligence” and maintained that the only “reprehensible” delay is the failure to submit the contest immediately after the breakdown of negotiations with Qatar Airways and not 27 January.
